29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent.    a) In the facility, on or about December 12, 2019 - The employer did not administer a continuing, effective hearing conservation program whenever employee noise exposure levels exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent.  Two employees designated as welders were exposed to continuous noise levels at 113.3% and 85.8% of the allowable 8-hour time-weighted average sound level (90 dB).  The equivalent dBA level for the exposures was 90.9 and 88.9 respectively.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  a) In the facility, on or about December 12, 2019 - The employer did not establish and maintain an audiometric testing program for employees exposed to continuous noise at 113.3% and 85.8% of the allowable 8-hour time-weighted average sound level (90 dBA).  The equivalent dBA level for the exposures was 90.9 and 88.9 dBA respectively.

The employer did not institute a training program and ensure employee participation in the program:     a) In the facility, on or about December 12, 2019 - The employer did not train employees exposed to noise at or above an 8-hour time-weighted average level of 85 dBA in the effects of noise, the purposes, advantages, disadvantages, and attenuation of various types of hearing protectors, and the purposes and procedures of audiometric testing.
