29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about November 18 2019, and at times prior thereto, the company failed to ensure the operator of the rough terrain forklifts was trained. Both rough terrain forklifts were rented by the company and permitted to be used by subcontractors without the proper training and certification to operate. The operator was lifting employees and materials in a personnel work platform attached to the forklift. Thus, exposing employees to the hazard of being struck by a forklift or load.
