29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    Location: cut off/rough grind, finish department    a) On or about November 20, 2019, the employer did not develop and implement a hearing conservation program for employees exposed to noise levels exceeding the OSHA action level of 85 decibels for an 8 hour time weighted average while operating the cut off saw. The employee was exposed to noise level at 235.9% dose which is above the action level of 50% dose (85 dBA) during the 362 minute sampling period. The equivalent level of the 235.9% dose is 96.1 dBA for an 8 hour Time weighted Average (TWA).       b) On or about November 20, 2019, the employer did not develop and implement a hearing conservation program for employees exposed to noise levels exceeding the OSHA action level of 85 decibels for an 8 hour time weighted average while operating the water blast and grinding station. The employee was exposed to noise level at 99.6% dose which is above the action level of 50% dose (85 dBA) during the 354 minute sampling period. The equivalent level of the 99.6% dose is 89.9 dBA for an 8 hour Time weighted Average (TWA).       c) On or about November 20, 2019, the employer did not develop and implement a hearing conservation program for employees exposed to noise levels exceeding the OSHA action level of 85 decibels for an 8 hour time weighted average while hand grinding copper parts. The employee was exposed to noise level at 112.7% dose which is above the action level of 50% dose (85 dBA) during the 340 minute sampling period. The equivalent level of the 112.7% dose is 90.8 dBA for an 8 hour Time weighted Average (TWA).       d) On or about November 20, 2019, the employer did not develop and implement a hearing conservation program for employees exposed to noise levels exceeding the OSHA action level of 85 decibels for an 8 hour time weighted average while operating the auto sander, and supervising the finishing department. The employee was exposed to noise level at 91.3% dose which is above the action level of 50% dose (85 dBA) during the 345 minute sampling period. The equivalent level of the 91.3% dose is 89.3 dBA for an 8 hour Time weighted Average (TWA).       e) On or about November 20, 2019, the employer did not develop and implement a hearing conservation program for employees exposed to noise levels exceeding the OSHA action level of 85 decibels for an 8 hour time weighted average while operating the glovebox. The employee was exposed to noise level at 109.3% dose which is above the action level of 50% dose (85 dBA) during the 349 minute sampling period. The equivalent level of the 109.3% dose is 90.6 dBA for an 8 hour Time weighted Average (TWA).

29 CFR 1910.95(i)(2)(i): The employer did not ensure that hearing protectors are worn by an employee who is required by 29 CFR 1910.95(b)(1) to wear personal protective equipment:    Location: cut off saw     a) On or about November 20, 2019, the employer did not require an employee to wear hearing protection where they were exposed to levels greater than the permissible exposure limit (PEL).  The employee was exposed to noise level at 213.3% dose which is above the PEL level of 100% dose (90 dBA) during the 362 minute sampling period. The equivalent level of the 213.3% dose is 95.6 dBA for an 8 hour Time weighted Average (TWA) and hearing protection was not worn.
