29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical agents:  a) At 1147 Willow View Dr., Lot 11 The Springs of Mill Lakes, Opelika, Alabama:  On or about November 13, 2019 and at times prior; the employer allowed his employees to operate pneumatic nail guns without eye protection exposing his employees to struck-by hazards.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) At 1147 Willow View Dr., Lot 11 The Springs of Mill Lakes, Opelika, Alabama:  On or about November 13, 2019 and at times prior; the employer allowed his employees to use an extension ladder to gain access to the second floor level of the house and the rails of the ladder did not extend three feet above the landing to provide safe access exposing his employees to a fall hazard of 11 feet 1 inch to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) At 1147 Willow View Dr., Lot 11 The Springs of Mill Lakes, Opelika, Alabama:  On or about November 13, 2019 and at times prior; the employer allowed his employees to perform roofing activities without fall protection exposing his employees to a fall hazard of up to 10 feet 8 inches to the ground below.  b) At 1147 Willow View Dr., Lot 11 The Springs of Mill Lakes, Opelika, Alabama:  On or about November 13, 2019 and at times prior; the employer allowed his employees to perform framing activities without fall protection exposing his employees to a fall hazard of up to 18 feet 9 inches to the ground below.  THE SERGIO TOVAR DBA TOVAR CONSTRUCTION WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER  1248349, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 29, 2017,  WITH RESPECT TO A WORKPLACE LOCATED AT 220 BROOKSHIRE COURT, LOT 210 MIMMS TRAIL, AUBURN, ALABAMA.
