29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    a) on or about 11/13/19, in front of a building located at 459 Broadway, Buffalo, NY:  One employee was inside of the elevated basket of a JLG Model 450AJ aerial lift using a DeWalt hand-held portable grinder to remove excess mortar from the perimeter of a wall opening as part of the process to install a window. The employee was not wearing a body harness with an attached lanyard, and was not tethered to the boom or basket of the lift in any other way.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a)  On or about 11/13/19, in front of a building located at  459 Broadway, Buffalo, NY:  an employee was using a DeWalt hand-held portable grinder to remove excess mortar from the perimeter of a wall opening as part of the process to install a window.  The grinding was conducted dry, without the use of a water delivery system that supplies a continuous stream or spray at the point of contact or a tool equipped with a commercially available shroud and dust collection system as required by Table 1.  NO ABATEMENT CERTIFICATION REQUIRED
