29 CFR 1926.251(a)(2): Employer did not ensure that rigging equipment:(i) Had permanently affixed and legible identification markings as prescribed by the manufacturer that indicate the recommended safe working load; (ii) Not be loaded in excess of its recommended safe working load as prescribed on the identification markings by the manufacturer; and (iii) Not be used without affixed, legible identification markings as required by paragraph (a)(2)(i) of this section. a) Barton Malow Company on or about November 4, 2019, at the worksite located at 2768 Front Street, Toledo, OH: The employer did not ensure the 3/8 wire rope sling used in conjunction with other rigging equipment to pull a section of cooling conveyor chain was labeled with an identification tag and was used within the load rating as prescribed by the manufacturer. An employee was struck by a snatch block after the wire rope sling was overloaded and failed during the pulling process.
