29 CFR 1910.23(b)(8): The employer did not ensure ladders were used only for the purposes for which they were designed:    (a)The TJX Companies, Inc. dba T.J. Maxx at 1611 Eglin Street, Rapid City, SD 57701: On or about and at times prior to November 8, 2019, the employer did not ensure an employee using a 10-foot Werner A-frame ladder to install seasonal multi-panel banners used the ladder only for the purposes for which it was designed. The employee installed the banner by swinging the banner in a manner that eyelets on the top edge of the banner fell onto hooks securing the banner in place. The employee held the banner with both hands during this process, using the bottom edge of the banner to push it towards the hooks and using the side of the banner to guide the eyelets onto the hooks. The use of the ladder does not comply with the manufacturer's instructions for proper use in that the employee did not maintain the center of the waistline between the side rails causing over-reach, did not maintain a firm grip, and did not face the ladder. The employee used the ladder in a manner that was outside the purpose for which it was designed to be used. This condition exposed an employee to a fall hazard.
