29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103) a) Mark Randolph dba Randolph Masonry, worksite located at 520 Peach St. Erie, PA 16501, on or about November 19th 2019 and times prior thereto: Employees were required to wear filtering face piece respirators (3M brand #8511 N95) during work tasks including, but not limited to, mixing of mortar products. The employer did not develop and implement a written respiratory protection program. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103) a) Mark Randolph dba Randolph Masonry, worksite located at 520 Peach St. Erie, PA 16501, on or about November 19th 2019 and times prior thereto: Employees were required to wear filtering face piece respirators (3M brand #8511 N95) during work tasks including, but not limited to, mixing of mortar products.
