29 CFR 1910.29(b)(1): The top edge height of top rails, or equivalent guardrail system members, were not 42 inches, plus or minus 3 inches, above the walking-working surface:    (a) Packing Robot 10/11 - On November 19, 2019, the employer did not ensure that the height of top rail, on the entire guard rail system of the racetrack platform, was 42 inches, plus or minus three inches.The top rail for a portion of the guard rail system located at the end of the platform next to the south vibrato was lower and measured at approximately 36 inches above the walking working surface.    In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.29(b)(2)(i): 29 CFR 1910.29(b)(2)(i): Midrails were not installed at a height midway between the top edge of the guardrail system and the walking-working surface:  (a) Packing Robot 10/11 - On November 19, 2019, the employer did not ensure that a midrail was installed on guardrail systems.  The toprail installed at the end of the south platform adjacent to the south vibrators measured at 36 inches high was not equipped with a midrail.   (b) Packing Robot 10/11 - On December 3, 2019, the employer did not ensure that midrails installed on the platform were installed at height midway between the top edge of the guardrail system and the walking working surface. The toprail installed throughout the south platform measured at 39 inches high with midrails measuring at 12 inches high.    In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.

29 CFR 1910.29(b)(2)(iii): (iii) Intermediate vertical members (such as balusters) are installed no more than 19 inches (48 cm) apart;   (a) Packing Robot 10/11 - On December 3, 2019, the employer did not ensure that intermediate vertical members were installed no more than 19 inches apart. The distance between the vertical members throughout the guardrail system including the vertical members located at the end of the south platform guardrail system measured approximately 30 inches.   In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. 29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following:  Guardrail systems, safety net systems, or personal fall arrest systems:      (a) Packing Robot 10/11  - On or about October 25, 2019, the employer did not ensure that employees were protected from fall hazards of approximately nine feet, when accessing the mid section of the racetrack platform to perform sanitation and cleanup.    (b) Packing Robot 10/11 -  On or about October 25, 2019, the employer did not ensure that employees were protected from fall hazards of approximately nine feet when stepping off the platforms to access the racetrack platform to perform sanitation and cleanup.     (c) Packing Robot 10/11 - On or about October 25, 2019, the employer did not ensure that employees were protected from fall hazards of approximately nine feet when reaching through guard rails to retrieve materials such as cardboard boxes and mop heads to perform sanitation and cleanup.    On October 25, 2019, an employee suffered an severe occupational injury resulting from a fall when the employee reached across the elevator case through the guardrail to grab a mop head, falling through the elevator case opening approximately nine feet below into the Flexicell Packaging Robot system.     In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. 29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):    (a) Packing Robot 10/11 - On or about October 25, 2019, employees were exposed to machine hazards associated with moving parts when performing sanitation on equipment such as but not limited to the Packaging Robot.     The employer failed to implement energy control application steps such as LOTO devices were not applied to the electrical disconnect [per the 1910.147(d)(4) requirements]. As a result, the remaining applicable energy control elements, involving dissipation machine isolation [(d)(5)(2)], and verification of isolations [(d)(6)], were not implemented to protect employees from machine servicing hazards.      In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification.
