29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury: (a) New residential construction located at 17 Carrington Way. On or about 11/14/2019, and at times prior, the employer exposed his employee to struck-by hazards in that the employee was not provided with safety eye wear while operating a pneutools pneumatic framing nail gun at 120 PSI while conducting framing activities.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: (a) New residential construction located at 17 Carrington Way. On or about 11/14/2019, and at times prior, the employer exposed his employee to fall hazards in that the employee was working from the top cap of a 6 foot A-frame ladder conducting framing activities. The height was measured at 9 feet 4 inches from the ground level to the top of the new construction frame. Employees engaged in framing work were not provided with a ladder tall enough to reach the higher level without having to stand on the top cap.
