29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. The employer is failing to ensure that the eyes and face of employees are protected from flying particles while erecting wood frame components for a newly constructed house. This most recently occurred on November 20, 2019 on the jobsite located at16701 Longbow Loop, Omaha, NE 68136. An employee was observed using a hand-held circular saw and pneumatic nail gun without any form of eye or face protection.

29 CFR 1904.39(a)(2): The employer did not report the in-patient hospitalization of one or more employees to OSHA within twenty-four (24) hours. The employer has failed to report an employee in-patient hospitalization to OSHA within 24 hours. This most recent occurrence of this took place at the facility located at 16701 Longbow Loop, Omaha, NE 68136. On November 13, 2019 the employer and 2 employees were constructing a wood frame residential home. The employer and an employee were attempting to jump start the forklift using the company truck when the truck lunged forward pinning the employee between the two machines. The employee sustained injuries resulting in a hospitalization.
