29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles. The employer is failing to ensure that the eyes and face of employees are protected from flying particles while working on a residential roof. This most recently occurred on November 20, 2019 on the jobsite located at 3055 Armbrust Dr., Omaha, NE 68124. Employees were observed using hand-held pneumatic nail guns to install shingles on an existing 2-story house without any form of eye or face protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to ensure that all employees exposed to fall hazards while working on a residential roof are utilizing fall protection. This most recently occurred on November 20, 2019 on the jobsite located at 3055 Armbrust Dr., Omaha, NE 68124. The employer and 1 employee were observed installing new roofing materials on an existing house. Neither of them were utilizing any form of fall protection. The house has an 8 in 12 steep sloped pitch and ground to eave height is approximately 18.5 feet at the top level and 9.5 feet at the lower level.
