29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a)Armour Roofing & Construction at 501 Main Street, Deadwood, SD 57732: On or about and at times prior to November 19, 2019, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards as a result of conducting roofing activities without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 10 feet. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

Employees were installing ice block/dams on the roof of a commercial property. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a)Armour Roofing & Construction at 501 Main Street, Deadwood, SD 57732: On or about and at times prior to November 19, 2019, the exposing employer did not ensure that each employee engaged in roofing operations on a commercial property, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. This condition exposed employees to a fall hazard of approximately 10 feet.
