29 CFR 1910.119(h)(3)(iv): The contract employer shall assure that each contract employee follows the safety rules of the facility including the safe work practices required by paragraph (f)(4) of this section. On our about November 14, 2019, at the Total Petrochemical Refinery, in Port Arthur, Tx, the employer did not ensure that employees located in the yard near the Coker and the ACU2 Units had radios in their areas, in order to comply with the Port Arthur Refinery Integrated Contingency Plan (Emergency Action and/or Emergency Response Policy).
