29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part:   a) jobsite, 949 N Hermitage Rd. in Hermitage, PA.  On or about November 20, 2019, the employer did not initiate and maintain safety and health programs, in that, the company did not provide its employees with general safety and health rules  when performing construction activities.   ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms when the entire platform was not attached to the fork and the fork-lift is not moved horizontally while the platform is occupied:  a) jobsite, 949 N Hermitage Rd. in Hermitage, PA.  On or about November 20, 2019, a plywood platform was used on the forks of the JLG all-terrain forklift to lift employees to perform work including, but not limited to, accessing the dumpster.    ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

On or about November 20, 2019, employees were not protected from falling 10 feet to the ground while performing roof work on a 6:12 pitch roof. On or about November 20, 2019, a JLG all-terrain forklift was operated by employees to lift shingles and roofing materials to the roof.  A record of forklift operator training was not certified to verify that each employee had received training to operate the forklift.
