NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) South side, 4835 Central Ave., Ocean City: Employee without fall protection, approximately 22 feet above the next lower level, was trimming the subfloor at the edge of the deck, on or about 11/21/2019; b) West side, 4835 Central Ave., Ocean City: Employee without fall protection, approximately 22 feet above the next lower level, was loading and unloading materials as needed, at the edge of the deck, on or about 11/21/2019; c) East side, 4835 Central Ave., Ocean City: Employees without fall protection, approximately 22 feet above the next lower level, were working on the rear deck, on or about 11/21/2019. 29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) South, west, & east sides, 2nd floor level, 4835 Central Ave., Ocean City: Employees without any fall protection, exposed to approximate 22 foot falls to the ground below while working on the decks, stated they had not received any training in the recognition of fall hazards on the job and procedures to follow when exposed to falls greater than 6 feet, on or before 11/21/2020. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
