29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:  Employees conducted rain gutter installation from an aerial lift without fall protection.  Francisco Javier Hernandez dba Hernandez Roofing & Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 1408929, citation number 1, item number 2, and was affirmed as a final order on July 23, 2019, with respect to a workplace located at 11118 Wurzbach Rd, San Antonio, TX 78230.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Employees conducted roofing activities on a 2-story building without fall protection.  Francisco Javier Hernandez dba Hernandez Roofing & Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1408929, citation number 1, item number 3, and was affirmed as a final order on July 23, 2019, with respect to a workplace located at 11118 Wurzbach Rd, San Antonio, TX 78230.
