29 CFR 1910.147(c)(4)(ii)(D): The energy control procedures did not clearly and specifically outline the requirements for testing a machine or equipment to determine and verify the effectiveness of lockout devices, tagout devices, and other energy control    a)  On or about November 19, 2019, at the mail room department, the Lockout/tagout Procedures for machines such as QUIPP Series 350 Stacker, did not clearly and specifically outlined the steps for testing a machine to determine and verify the effectiveness of the lockout / tagout devices, exposing employees to caught-in, pneumatic and electrical hazards.

29 CFR 1910.147(c)(7)(i): The employer did not provide training to ensure that the purpose and function of the energy control program are understood by employees and that the knowledge and skills required for the safe application, usage, and removal of the energy controls are acquired by employees:    a)  On or about November 19, 2019, at the establishment located at 1800 University Parkway Sarasota, Florida, the employer had not trained authorized and affected employees in the control of hazardous energy program and procedures before operators and maintenance personal provided service and maintenance to machines such as the FERAG Stacker Infeed, QUIPP Series 350 Newspaper Stacker and Harris Graphics Inserter 1472. Employees were exposed to caught-in, pneumatic and electrical hazards.    NOTE: Training shall include the following:    1) Authorized employees shall receiving training in the recognition of applicable hazard energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.    2) Affected employees shall be instructed in the purpose and use of the energy control procedure.    3) All other employees whose work operations are or may be in an area where energy control procedures may be utilized   shall be instructed about the procedures, and about the prohibition relating to attempts to restart or reenergize machines or equipment which are locked out or tagged out.    4) Retraining shall be provided for all authorized and affected employees whenever there is a change in job assignment, machinery, equipment or processes that present a new hazard or when there is a change in the energy control procedures.    5) Additional retraining to be conducted to reestablish employee proficiency and introduce new or revised control methods and procedures as necessary or whenever a periodic inspection (performed by an authorized employee other than the ones utilizing the energy control procedures being inspected) reveals, or the employer has reason to believe that there are deviations from or inadequacies in the employee's knowledge or use of the energy control procedures.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    a)  On or about November 19, 2019, at the mailroom department area, the stacker infeed assembly (including the rollers and belts) were not guarded, exposing employees to caught-in hazards created by rotating parts.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.    a)  On October 31, 2019, at the mailroom located at 1800 University Parkway Sarasota, Florida, an employee suffered a work-related injury that resulted in a left thumb severed above the first knuckle. The employer was aware of the amputation on October 31, 2019 following the incident.  The employer notified OSHA on November 4, 2019 at 10:10 AM of the amputation.

29 CFR 1910.147(c)(6)(ii): The employer did not certify that periodic inspections of the energy control procedures had been performed:  a) On or about November 19, 2019, at the establishment located at 1800 University Parkway Sarasota, Florida, the employer failed to certify periodic inspections of the Lock Out / Tag Out Procedures.  The certification shall identify the machine or equipment on which the energy control procedures were being utilized, the date of the inspection, employees included in the inspection, and the person performing the inspection.
