29 CFR 1910.101(b): "Compressed gases." The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks shall be in accordance with Compressed Gas Association Pamphlet P-1-1965, which is incorporated by reference as specified in Sec. 1910.6.  Section 3.3.1 of the CGA Pamphlet P-1-1965 refers to storing cylinders in accordance with CGA and NFPA standards.  The CGA Pamphlet P-1-2015 Section 5.8.4 states that "All compressed gas cylinders in service or in storage at user locations shall be secured to prevent from falling or rolling."  a) Shop - On or about November 21, 2019, three (3) compressed gas cylinders of nitrogen were observed free standing and were not secured by any device to prevent the cylinders from falling, rolling, or getting knocked over.  No abatement certification or documentation required.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:   a)  Yard - On or about November 21, 2019 and times prior thereto, employees operated a Hyster forklift (Model S50XM) with a fabricated metal basket supported by the forks and the employer did not obtain the manufacturers prior written approval.  b)  Yard - On or about November 21, 2019 and times prior thereto, employees operated a Hyster forklift (Model S50XM) with a Vestil lift boom forklift attachment supported by the forks and the employer did not obtain the manufacturers prior written approval.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a)  Yard - On or about November 21, 2019 and times prior thereto, employees operated a Hyster forklift (Model S50XM) and the employer had not conducted the practical training and the workplace evaluation of employees as required under this standard.
