29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: a) Forklifts: On or about November 19, 2019 and at times prior thereto, an aftermarket work platform was used to elevate personnel prior to seeking and obtaining written approval, including updated load charts, from the manufacturers of the employers respective forklifts which exposed employees to injuries such as but not limited to forklift tip overs and falls.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) Warehouse and yard areas: On or about November 19, 2019 and at times prior thereto, employees were lifted on wood products supported by the forks of a forklift while conducting work related activities, such as but not limited to pulling orders from the higher racks and installation of components of electrical systems, which exposed employees to injuries related to falls up to 30-40 feet to the paved ground. a) Forks of Telehandler: On or about April 10, 2014, the employer allowed the use of a wooden pallet on the forks to elevate personnel which exposed an employee to falls up to 13-feet. Among others, one feasible abatement method is equip the lift with a platform meeting the requirements of ANSI/ITSDF B56.1 - 2009, Section 7.37 Platform: Elevating.
