29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146 a) Facility; On or about November 19, 2019 and time prior; The employer required employees to work on the inside of spaces such as but not limited to the wood grinder, a permit required confined space while performing maintenance activities such as but not limited to replacing teeth/cutting heads and did not develop and/or implement a permit required confined space program with the procedures necessary to safeguard employees from the hazards in the space.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a) Facility: On or about November 19, 2019 and at times prior, procedures had not been developed, documented and/or utilized for the control of potentially hazardous energy, where employees were exposed to caught-in, struck-by, and crushed-by hazards, when performing servicing, setup, and maintenance activities on equipment including, but not limited to, the grinder which had hydraulic, pneumatic and electrical energy sources. b) Facility: On or about November 19, 2019 and at times prior, procedures had not been developed, documented and/or utilized for the control of potentially hazardous energy, where employees were exposed to caught-in, struck-by, and crushed-by hazards, when performing servicing, setup, and maintenance activities on equipment including, but not limited to, pallet stacker which had hydraulic, pneumatic and electrical energy sources.
