29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary: (a) Shoppes at Village Hill, North side scaffold: On or about 1/25/2019, and at times prior, the employer exposed employees to trip/fall hazards on the scaffold work platform, in that the aluminum planks had a space greater than 1-inch between the scaffold platforms which created a hazard on the walking/working surface as employees were engaged in stucco applications.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, were used on top of scaffold platforms to increase the working level height of employees: (a) Shoppes at Village Hill, North side scaffold: On or about 1/25/2019, and at times prior, the employer exposed employees to fall hazards of approximately 16-feet, 8-inches on the scaffold work platform, in that a stack of foam boards was used to increase the worker's height to apply a base coat of stucco to the decorative cornice on the eave of the roof. The employee increased his height 2-feet by standing on the foam boards which were still enclosed in the clear plastic packaging.
