29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s)(a)(  a) Lumber Yard - On or about November 26, 2019, the employer failed to repair a broken taillight on the CAT DP40KL-D forklift.  The forklift was used on November 25, 2019, to load lumber for delivery.  Employees were exposed injuries associated with broken or malfunctioning equipment, including sprains, fractures, and broken bones.    b) Lumber Yard - On or about November 26, 2019, the employer failed to repair the lower seat cushion on the CAT DP40KL-D forklift.  The forklift was used on November 25, 2019, to load lumber for delivery.  Employees were exposed to injuries  associated with broken or malfunctioning equipment, including sprains, fractures, and broken bones.

29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer.  a) Lumber Yard - On or about November 26, 2019, the CAT P6000 forklift was altered in that the seatbelt was tied behind the seat cushion and not available for use.  Employees were exposed to injuries associated with altered or removed parts, including sprains, fractures, and broken bones.

29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service:  a)  Lumber Yard - On or about November 26, 2019, and dates prior to, the CAT P6000 (Serial Number AT14E00248), and CAT DP40KL-D 9 (Serial Number AT19C70255) forklifts were not examined on a daily basis.  The powered industrial vehicles were not regularly examined prior to use to verify their condition, thereby exposing employees to injuries which could include sprains, fractures, and broken bones.
