29 CFR 1926.20(b)(2): Accident prevention responsibilities. Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.   a) On or about 11/25/2019 there was no frequent and regular inspection program being maintained in use by a competent person to ensure the job site, material and equipment; such as fall protection systems was being utilized.

29 CFR 1926.1053(b)(4): Use. The following requirements apply to the use of all ladders, including job-made ladders, except as otherwise indicated: Ladders shall be used only for the purpose for which they were designed.   a) On or about 11/25/2019, employee working off an A-frame ladder on top of a lower level roof at heights of 10.7 ft. from the ground.  The ladder was closed, folded and leaning against the structure, not being utilized for the purpose for which it was designed.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a) On or about 11/25/2019 An employee was framing a new residential property, with no fall protection system in place. Employee was exposed to fall hazard. The height of the fall hazard was measured at 19.8 ft. from the ground, on the (front) south side of the structure.   b) On or about 11/25/2019 Two employees were framing a new residential property, with no fall protection system in place. Employees were exposed to fall hazards. The height of the fall hazard was measured at 27 ft. from the ground, on the (back) north side of the structure.   The D Baker Enterprise, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1115774, citation number 1, item number 1 and was affirmed as a final order on 02/10/2016, with respect to a workplace located at 6895 Roberts Park Dr. Mason, OH 45040.

29 CFR 1926.503(a)(1): Training program. The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   a) On or about 11/25/2019 employees have not been trained on fall protection systems and on hazards of falls, while working at heights above 20 ft. from the ground.     The D Baker Enterprise, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(1), which was contained in OSHA inspection number 1115774, citation number 1, item number 1 and was affirmed as a final order on 02/10/2016, with respect to a workplace located at 6895 Roberts Park Dr. Mason, OH 45040.
