29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a) Broe Management Company LLC at 2000 Howard Smith Ave, Building C15, Windsor, CO: On and before November 21, 2019, the employer did not ensure that ingoing nip points on Triminator Buckmasters were guarded. An employee, processing hemp at a Triminator Buckmaster was exposed to an ingoing nip point, when his finger passed through the hole on the Bucking Plate into the rollers. This condition resulted in the amputation of the worker's finger and exposed other employees to the machine guarding hazard.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a) Broe Management Company LLC at 2000 Howard Smith Ave, Building C15, Windsor, CO: On and before November 21, 2019, the employer did not provide employees with effective information and training on hazardous chemicals in their work area.  Employees did not know the hazards of the chemicals in their work areas. This condition exposed employees to chemical hazards, including but not limited to hemp, hydrogen peroxide 35%, isopropanol 99%, ethyl alcohol 95%, and Rust-Oleum Spray Paint.       Abatement Note: Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  (a) Broe Management Company LLC at 2000 Howard Smith Ave, Building C15, Windsor, CO: On and before November 21, 2019, the employer did not ensure that any employee using a respirator voluntarily was provided with the information contained in Appendix D to this section when the employer determined that any voluntary respirator use was permissible.  The employer provided 3M Model 9010 N95 filtering face piece respirators for voluntary use.  This condition potentially exposed the employees to a respiratory hazard.
