29 CFR 1926.20(b)(2): "Accident prevention responsibilities." Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. (a) On or about Nov. 22, 2019, located at the 6th floor of a parking garage structure, there were no frequent and regular inspections being performed by a competent person in that employees erected formwork, that later collapsed during a concrete pour, while using the same shoring layout in the area of a 24 inch slab thickness as that used in areas of 8 inch slab thickness. (b) On or about Nov. 22, 2019, located at the 6th floor of a parking garage structure, there were no frequent and regular inspections being performed by a competent person in that employees adjusted the height of the formwork, that later collapsed during a concrete pour, in order to accommodate the 24 inch concrete thickness of the 7th floor slab fold area without determining the correct form spacing. (c) On or about Nov. 25, 2019, located at the 6th floor of a parking garage structure, there were no frequent and regular inspections being performed by a competent person in that employees erected formwork, that later collapsed during a concrete pour, that was not inspected by a competent person immediately before and during placement of wet concrete.

29 CFR 1926.21(b)(2): "Accident prevention responsibilities." The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about the Nov. 22, 2019, located at the 6th floor of a parking garage structure, employees erected formwork for cast-in-place concrete that had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work.

29 CFR 1926.703(a)(1): "General requirements for formwork." Formwork shall be designed, fabricated, erected, supported, braced and maintained so that it will be capable of supporting without failure all vertical and lateral loads that may reasonably be anticipated to be applied to the formwork. Formwork which is designed, fabricated, erected, supported, braced and maintained in conformance with the Appendix to this section will be deemed to meet the requirements of this paragraph. During construction of the 7th floor of the parking garage located at Fourth and Race, the employer failed to adequately review initial and revised shoring plans provided by outside engineering firms to account for additional loads imposed by a 24" slab section of that floor.

29 CFR 1926.703(a)(2): "General requirements for formwork." Drawings or plans, including all revisions, for the jack layout, formwork (including shoring equipment), working decks, and scaffolds, shall be available at the jobsite. On Nov. 25, 2019, located on the 6th floor of a parking garage structure, employees were exposed to struck-by hazards from formwork failure in that approved engineered drawings were not available at the jobsite to account for a 24 inch thick slab fold area on the 7th floor. Updated shoring calculations were not submitted to the shoring designer and engineer to develop new drawings, resulting in overloading of the shoring system and collapse of the formwork after placement of wet concrete.
