29 CFR 1926.102(a)(1): 29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles:    A) On November 22, 2019, the employer did not ensure each employee operating a pneumatic nail gun used appropriate eye or face protection.  Eye protection was provided to the employees.    B) On December 11, 2019, the employer did not ensure each employee operating a pneumatic nail gun used appropriate eye or face protection.  Eye protection was provided to the employees.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    On November 22, 2019, the employer did not ensure employees were protected from falling while installing decking on the fourth floor.  Guardrails had been established on the west side of the building, but had not been installed on the east side where employees were putting down decking.  Employees were working near the unprotected edge of the building while wearing a harness that was not connected to an anchor point.  No other fall protection systems were implemented.

29 CFR 1926.502(a)(2): The employer did not provide and install all fall protection systems required by this subpart for employee(s) and did not comply with all other pertinent requirements of this subpart before employee(s) began the work that necessitates the fall protection:  On November 22, 2019, the employer did not ensure employees were protected from falling while installing decking on the fourth floor.  The employer did not provide and install fall protection systems before employees began work on the east side of the building.
