29 CFR 1926.20(b)(2): "Accident prevention responsibilities." Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) On or about the 151-day period of June 20 - Nov. 18, 2019, located at 22 pour locations throughout a parking garage structure, there were no frequent and regular inspections being performed by a competent person in that employees were placing wet concrete while standing on erected formwork that had not been inspected by a competent person.  (b) On Nov. 25, 2019, located on the 7th floor of a parking garage structure, there were no frequent and regular inspections being performed by a competent person in that employees were placing wet concrete while standing on erected formwork that had not been inspected by a competent person. The erected formwork later collapsed during placement of wet concrete.

29 CFR 1926.21(b)(2): "Accident prevention responsibilities." The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On or about the 158-day period of June 20 - Nov. 25, 2019, located throughout a parking garage structure, employees placing and finishing wet concrete slab while standing on erected formwork had not been instructed on the applicable procedures and/or regulations to minimize those hazards while performing this work.

29 CFR 1926.703(a)(1): "General requirements for formwork." Formwork shall be designed, fabricated, erected, supported, braced and maintained so that it will be capable of supporting without failure all vertical and lateral loads that may reasonably be anticipated to be applied to the formwork. Formwork which is designed, fabricated, erected, supported, braced and maintained in conformance with the Appendix to this section will be deemed to meet the requirements of this paragraph.  On Nov. 25, 2019, located on the 7th floor of a parking garage structure, employees placing wet concrete fell approximately 15' 4" to the next lower level when the formwork erected by another subcontractor collapsed. The erected formwork was not designed, erected and supported to account for a 24 inch thick slab fold area on the 7th floor and the employer, having been made aware of missing shoring calculations that were not submitted to the shoring designer and engineer, did not take reasonable alternative steps to protect its employees prior to the collapse of the formwork after placement of wet concrete.
