OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. The employer is failing to protect employees from capsizing and drowning hazards while operating a boat. This was most recently documented on November 21, 2019 on the Mississippi River located near the I-74 bridge construction project in Bettendorf, IA. Four employees were exposed to capsizing and drowning hazards when they exceeded the maximum weight capacity of an 18 foot Kann Boat (model 1860 FB). AMONG OTHER METHODS, FEASIBLE AND ACCPETABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE: 1) Ensuring that employees are informed of the manufacturers weight capacities of the boat and that weight capacities are not exceeded. 2) Providing employees with a boater safety course approved by the U.S. Coast Guard Auxiliary.
