29 CFR 1910.1026(d)(2)(i): The employer using the scheduled monitoring option did not perform initial monitoring to determine the 8-hour time-weighted average exposure to chromium (VI) for each employee on the basis of a sufficient number of personal breathing zone air samples to accurately characterize full shift exposure on each shift, for each job classification, in each work area: (a) Trim Room/Paint Booths: On or about December 5, 2019 the employer had not performed a sufficient number of personal air samples during higher volume jobs to accurately characterize employee exposure levels in that Final Finish Builders have the potential to be exposed over the Action Level for greater than 30 days per year. An employee was exposed on January 7, 2020 to hexavalent chromium at an 8-hour Time Weighted Average of 3.39 micrograms per cubic meter of air which exceeded the Action Level of 2.5 micrograms per cubic meter of air.

29 CFR 1910.1026(k)(1)(i)(A): The employer did not make medical surveillance available for all employees who were or could be occupationally exposed to chromium (VI) at or above the action level for 30 or more days a year: (a) Trim Room/Paint Booths: On or about December 5, 2019 the employer had not made medical surveillance available to all employees who were or could be exposed at or above the Action Level for 30 or more days per year. An employee (Final Finish Builder) was exposed to Hexavalent Chromium on January 7, 2020 at an 8-hour Time Weighted Average of 3.39 micrograms per cubic meter of air which is over the Action Level.

29 CFR 1910.1026(h)(1): A hazard was present or was likely to be present from skin or eye contact with chromium (VI) and the employer did not ensure that employees used such clothing and equipment: (a) Trim Room: On or about January 7, 2020 the employer did not ensure that employees used the company required protective clothing during operations where employees have potential skin exposure from dust containing hexavalent chromium. A Final Finish Builder was exposed to hexavalent chromium at an 8-hour Time Weighted Average of 3.39 micrograms per cubic meter of air and the employee was not wearing the company required long sleeve smock during sanding operations. (b) Paint Booths: On or about January 7, 2020 the employer did not ensure that employees used the company required protective clothing during operations where employees have the potential for skin exposure from sprayed on material containing hexavalent chromium. A Final Finish Builder was exposed to hexavalent chromium at an 8-hour Time Weighted Average of 3.39 micrograms per cubic meter of air and the employee was not wearing the company required head covering during primer spraying operations.
