29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: On or about December 6, 2019, employees were exposed to a cave in, while performing excavation work at a commercial building located at 1867 W Market Street, Akron Ohio 44313. The employees were in a 5.2 feet deep trench and the employer did not ensure cave in protection was in place.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about December 6, 2019, employees were exposed to a fall of approximately 6.5 feet while performing excavation work at a commercial building located at 1867 W Market Street, Akron Ohio 44313. The employees were using a ladder to access a trench and the employer did not ensure that it extended 3 feet above the landing area.
