29 CFR 1910.178(l)(1)(i): (Operator training.)(Safe operation.) The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  On Dec. 5, 2019, located at a commercial jobsite, employees working from a tubular welded frame scaffold were exposed to struck-by hazards in that an employee was operating a Skyjack VR843E telehandler that had not received training required by this subpart.

29 CFR 1926.20(b)(2): (Accident prevention responsibilities.) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On Dec. 5, 2019, located at a commercial structure, there were no frequent and regular inspections being performed by a competent person in that employees were: working from three tubular welded frame scaffolds that did not have installed walkways for transit between the scaffolds; working from three tubular welded frame scaffolds that did not have midrails installed underneath cross braces; working from two tubular welded frame scaffolds that had been connected together with one premanufactured guardrail and three fabric slings; working from two tubular welded frame scaffolds that did not have guardrails on the open ends; working from a tubular welded frame scaffold that had one end of a platform that did not extend at least 6 inches over the centerline of its support; working with mixed mortar without eye protection; and working from a tubular welded frame scaffold at fall heights of 14 feet 8 inches above ground level without a fall protection system.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  On Dec. 5, 2019, employees were performing masonry work from a tubular welded frame scaffold that had not received instruction on how to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.

29 CFR 1926.451(g)(1): (Scaffold platform construction.) Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  On Dec. 5, 2019, located at a commercial structure, employees were performing masonry work from the working level platforms of four tubular welded frame scaffolds that did not have several guardrails installed while not utilizing a fall protection system. Potential fall heights were measured to be 14 feet 9 inches above ground level.
