29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:    a) 1 Pennval Road, Woodbridge, NJ 07095 - Shop Area/Finished Chassis Area    Employees working as welding mechanics were exposed to noise levels above 85 dbA as a time-weighted average without the employer having an effective hearing conservation program to include elements such as but not limited to monitoring, an audiometric testing program, the availability of various hearing protectors and a training program.    Condition noted on or about 1/29/2020.    WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19

29 CFR 1910.134(c)(1): In any workplace where respirators were necessary to protect the health of the employee or whenever respirators were required by the employer, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures. A program was not updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer did not include in the program the provisions of this section, as applicable:    a) 1 Pennval Road, Woodbridge, NJ 07095 - Shop Area/Blast Cleaning Room    Employees were required to wear N95 dust masks and supplied-air respirators (SARs) while using steel grit (angular steel pellets) containing hexavalent chromium, for impact treatment of metallic chassis surfaces. The employer did not establish a written respiratory protection program to cover these employees.    Condition noted on or about 12/10/2020.    b) 1 Pennval Road, Woodbridge, NJ 07095 - Shop Area/Spray Paint Booth    Employees were required to wear N95 dust masks, half face respirators and full face respirators while spray painting chassis using paints and hardeners such as but not limited to Q370K1398 Black HS Urethane Enamel, containing n-butyl acetate and xylenes. The employer did not establish a written respiratory protection program to cover these employees.    Condition noted on or about 12/10/2020.
