29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: On or about December 10, 2019, at a warehouse facility located at 4597 Van Epps Rd, Brooklyn Heights, Ohio 44131; the employer did not ensure that employees utilizing black plastic totes (Black Plastic Tote 3.9 feet wide, 3.2 feet long, 2.8 feet tall with fold down sides for accessing material placed inside the tote) as elevated working surfaces with unprotected sides and edges were protected from falls greater than 4 feet above the ground.
