29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a) Urban Outfitters, Inc. d.b.a. Anthropologie at 3000 E 1st Ave, Denver, CO: On and around December 2, 2019, the employer did not assess the workplace to determine if hazards were present or likely to be present, which necessitated the use of PPE. Employees cleaned up sewage with an unknown disinfectant but did not assess the hazards of sewage, the unknown disinfectant chemicals and select PPE. This condition potentially exposed the employees to biological and chemical hazards associated with sewage (e.g. bacteria, funguses, parasites, and viruses that can cause intestinal, lung, and other infections and hydrogen sulfide, carbon monoxide, and ammonia), and unknown chemical hazards from the unidentified disinfectant. (b) Urban Outfitters, Inc. d.b.a. Anthropologie at 3000 E 1st Ave, Denver, CO: On and around December 12, 2019, the employer did not assess the workplace to determine if hazards were present or likely to be present, which necessitated the use of PPE. Employees painted with Behr Marquee Ceiling Flat Paint & Primer - Pure White but the employer did not assess the hazards of the paint and select PPE. This condition exposed employees to serious eye damage and irritation hazards. (c) Urban Outfitters, Inc. d.b.a. Anthropologie at 3000 E 1st Ave, Denver, CO: On and around December 2, 2019, the employer did not assess the workplace to determine if hazards were present or likely to be present, which necessitated the use of PPE. An employee used Roman PRO-838 Heavy Duty Clear Adhesive but the employer did not assess the hazards of the adhesive and select PPE. This condition exposed the employee to chemical hazards such as eye damage and irritation, skin corrosion, and dermal sensitization.

29 CFR 1910.1200(f)(6): The employer used written materials, such as signs, placards, process sheets, or batch tickets in lieu of affixing labels to individual stationary process containers that failed to identify the container(s) to which they were applicable and did not convey the information required by 29 CFR 1910.1200(f)(5): (a) Urban Outfitters, Inc. d.b.a. Anthropologie at 3000 E 1st Ave, Denver, CO: On and around December 31, 2019, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the hazardous chemicals contained within. The employer failed to implement the globally harmonized system (GHS) for the labelling of chemical containers. Portions of the manufacturer's label on a bottle of Clean Strip Mineral Spirits and several paint cans had become partially illegible due the spirits container having a large yellow sticker and the paint cans being covered by paint. The employer failed to put GHS labels on the chemical containers. This condition potentially exposed employees to fire hazards.

Anthropologie at 3000 E 1st Ave, Denver, CO: On and around December 12, 2019, the employer did not provide medical evaluations to determine each employee's ability to use a respirator, before the employee was fit tested or allowed to use a respirator in the workplace. This condition may allow employees with pre-existing medical conditions to use respirators when they are not physically capable of doing so. Abatement Note: When tight-fitting filtering facepieces voluntary usage is allowed by the employer, you must ensure that the workers are medically able to wear the respirators. Using a respirator may place a physiological burden on employees that varies with the type of respirator worn, the job and workplace conditions in which the respirator is used, and the medical status of the employee. "Appendix C to Sec. 1910.134: OSHA Respirator Medical Evaluation Questionnaire" contains the mandatory information that employees must complete so that a physician (health care professional) may decide if it is appropriate for the employees to wear a respirator.
