29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: A) D & A Luna Construction, LLC, conducting work at 6110 Milan Road, Sandusky, OH 44870: On or about December 12, 2019, the employer did not ensure that employees were protected from hazards that could result in a head injury. Employees were not using protective hard hats while working below employees who were assembling the scaffold above. Employees were exposed to potential impact injuries caused by falling materials and/or equipment.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used: A) D & A Luna Construction, LLC, conducting work at 6110 Milan Road, Sandusky, OH 44870: On or about December 12, 2019, the employer did not ensure that employees used acceptable means of access to the scaffold such as, but not limited to, access ladders. The employees were using the scaffolds frame to access the scaffold at the height of approximately 24 feet above the ground. Employees, working in this condition, were exposed to approximately 24 feet fall hazard from the scaffold to the ground below.

Employees, working in this condition, were exposed to approximately 30 feet fall hazard from the scaffold to the ground below.
