29 CFR 1926.451(a)(1): Each scaffold and/or scaffold component was not capable of supporting, without failure, its own weight and at least 4 times the maximum intended load applied or transmitted to it.    Location:  a) Scaffold on roof (2nd tier of two-tear scaffold) b) Scaffold on roof (4th tier of four-tier scaffold)  On or about 12/11/2019, an employee walked and worked on the 2nd tier of the two-tier scaffold and on the 4th tier of the four-tier scaffold to perform masonry work such as, but not limited to, bricklaying. The scaffolds were erected with platforms made with materials such as insulation boards and plywood.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  Location:  a) Scaffold on roof (2nd tier of two-tear scaffold) b) Scaffold on roof (4th tier of four-tier scaffold)  On or about 12/11/2019, an employee walked and worked on the 2nd tier of the two-tier scaffold and on the 4th tier of the four-tier scaffold to perform masonry work such as, but not limited to, bricklaying. 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access.  Location: a) Scaffold on roof (4th tier of four-tier scaffold)  On or about 12/11/2019, an employee used the scaffolds on site to perform bricklaying and other masonry work. employees was not provided with access ladders to each working platform and, as a result, climbed the crossbraces & frames of the scaffold.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  Location: a) Scaffold on roof (4th tier of four-tier scaffold)  On or about 12/11/2019, an employee used the scaffolds on site to perform bricklaying and other masonry work. The employee was not protected by adequate guardrails or personal fall arrest systems with anchorage tie-off points when on the 4th tier of the scaffold.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge.  Location: a) Wooden stairway to roof; 5th floor landing leading to roof  On or about 12/11/2019, employees used the wooden stairway to access the roof to perform work. A stairrail was missing on the exposed left side of the stairway.  Acer Restorations LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1052(c)(1), which was contained in OSHA inspection number 1090917, citation number 1, item number 4 and was affirmed as a final order on 3/15/2016, with respect to a workplace located at 323 East 52nd Street, New York, NY 10022. Failure to abate, for the same citation, affirmed as final order on 10/31/2017.

The employee did not recognize silica exposure and health hazards to determine the use of personal protective equipment such as respirators.
