29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): Worksite located at 5220 Crabapple Lane, Kansas City, Missouri- The operator of the front end loader had not been certified to operate the forklift and had also raised the employees in an unsafe manner using a loader that was also subject to vehicular traffic.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. Worksite located at 5220 Crabapple Lane, Kansas City, Missouri- Employees were in the process using pneumatic nail guns near their eyes and were not protected from eye trauma by the use of any means of eye protection.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: Worksite located at 5220 Crabapple Drive, Kansas City, Missouri- Employees were exposed to fall hazards in that teh employees were observed working on the top of a platform suspended by a front end loader in which the loader and platform were not designed to lift personnel.
