The employer did not have an effective extermination program. Employees were exposed to rodent borne diseases such as Hantavirus.

29 CFR 1910.141(a)(5): A continuing and effective extermination program was not instituted where rodents, insects, or other vermin were detected:    Inside Building 441: After employee cleaned work area on morning of December 11, 2019, during afternoon inspection, new rodent droppings were observed inside various electronic equipment, inside office printer paper trays, in employee break room beside refrigerator, on and around employee's desks, and in the open bay work area on the floor next to equipment. The employer did not have an effective extermination program. Employees were exposed to rodent borne diseases such as Hantavirus.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment.    Inside building 441: Employees used cloth gloves while spraying Whitmore Micro-Gen Prescription Treatment Wasp-Freeze to eradicate wasps inside the work area and to remove rodent feces and dead rodents from various types of electronic equipment, office equipment, bait traps, mechanical traps, and the Hoover vacuum. Employer's hazard assessment specified the use of a diluted bleach solution which employees could not use without degrading or rendering the electronic equipment, office equipment, and the Hoover vacuum inoperable. Employer did not re-assess the hazards associated with the use of a bleach solution and provide an alternate method of disinfection prior to removal.  Employees were exposed to dermal and eye hazards and rodent borne diseases such as Hantavirus.

29 CFR 1910.106(d)(5)(iii): Storage of flammable liquids in office occupancies, except that which is required for maintenance and operation of building and operation of equipment, was not prohibited. Such storage was not kept in closed metal containers stored in a storage cabinet or in safety cans or in an inside storage room not having a door that opens into that portion of the building used by the public.    Inside Work area with Electronic Equipment, Office Space, and Break Room: Employees store Whitmore Micro-Gen Prescription Treatment Wasp-Freeze Aerosol cans on tables and desks inside the office occupancy spaces. Employer did not prohibit the storage of these chemicals from inside the office and require chemicals to be stored in the flammable storage cabinet.  Employees were exposed to explosive and fire hazards.
