29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  a) Worksite, 1000 Sunrise Blvd, Blue Point, New York, southern residential unit: Employees were operating a nail gun while framing a balcony and was not using eye protection, on or about 11/19/19.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  a) Worksite, 1000 Sunrise Blvd, Blue Point, New York, southern residential unit: An employee was working from an open sided overhang approximately nine feet above the ground and were exposed to falling, on or about 11/19/19.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards.  a) Worksite, 1000 Sunrise Blvd, Blue Point, New York, southern residential unit: Employees were performing siding work from the overhang above a garage of a residential building approximately nine feet above the ground. The employees were not protected from falling and were not provided with fall protection training, on or about 11/19/19.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
