29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  At the worksite, the employer did not have a written Respiratory Protection Program for employee(s) performing tasks such as, but not limited to, cutting ceramic tile with a right angle grinder and mixing chemicals containing silica, exposing employees to respiratory hazards.  Elements of an effective Respiratory Protection Program include but are not limited to the following:  Medical Evaluations and Fit Tests for employees required to use respirators Training on the limitations, proper care and storage of respirators. Identifying tasks/hazards/exposures for which respirators are required.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)    At the worksite, the employer did not have a written Hazard Communication Program for employee(s) performing tasks such as, but not limited to, cutting ceramic tile with a right angle grinder and mixing chemicals containing silica and Portland cement, exposing employees to eye, skin and respiratory hazards.  Elements of an effective Hazard Communication Program include but are not limited to the following:  Maintaining the program and Safety Data Sheets readily available to employees, Training employees how to use the information on Safety Data Sheets in order to prevent exposure to chemicals.  Such training shall include the specific health hazards of chemicals, personal protective equipment to be used, along with any other methods required to minimize exposure.
