29 CFR 1910.147(c)(2)(ii): If an energy isolating device is capable of being locked out, the employer's energy control program under paragraph (c)(1) of this section shall utilize lockout, unless the employer can demonstrate that the utilization of a tagout system will provide full employee protection as set forth in paragraph (c)(3) of this section. On or about January 9, 2020, the employer failed to ensure that the Modern Hydraulic Press, which was capable of being locked and tagged out, was locked and tagged out prior to employees performing the task of die change outs.

29 CFR 1910.147(c)(7)(i): At this establishment, the employer had not provided training to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices when maintaining and servicing equipment: On or about January 9, 2020, the employer failed to ensure that employees tasked with changing out the dies on the Modern Hydraulic Press, were trained as authorized to apply locks and tags to control hazardous energy, to include but not limited to electric and hydraulic, prior to changing out the dies.
