29 CFR 1910.176(b): The employer did not ensure secure storage or that storage of material shall not create a hazard. Bags, containers, stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse: On or about December 23, 2019, employees were exposed to falling materials and struck-by hazards from tiered super sack totes that collapsed due to damage and leakage. Tiered super sack totes were stored in vertical levels which were askew and that created instability as they were not stacked or interlocked to prevent sliding or collapse. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about December 23, 2019, employees were exposed to struck-by hazards and falling materials from employees of unknown qualifications operating forklifts. The employer failed to provide training and evaluation in order to certify that each authorized forklift operator had been trained and evaluated. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
