29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: On December 26, 2019 and at times prior thereto, employees were exposed to a fall hazard while installing roofing sheeting onto the top section of the roof at a height greater than six feet without being anchored or using fall protection.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: Southside of this Residential: On or about December 26, 2019, and at times prior thereto, employees with no fall protection were exposed to fall hazards, greater than 6 feet to the ground below while working from the roof without being trained on fall hazard recognition.
