29 CFR 1926.21(b)(2):  The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  The employer is failing to ensure employees are adequately trained to recognize and avoid engulfment hazards associated with working in an excavation.  The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017.  Employees were not trained by the employer to be able to recognize and avoid hazards associated with working in excavations that are outlined in 29 CFR 1926 Subpart P.

29 CFR 1926.100(a):  Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmet.  The employer is failing to protect employees from struck-by hazards associated with working in trenches and excavations.  The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017.  An employee was working inside a trench measuring approximately 20.5 feet deep X 45 feet long X 8 feet wide without a protective helmet.  The employee was exposed to loose spoils and clumps of compacted soil that could fall from the edge of the excavation.

29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:   The employer is failing to protect employees from engulfment and struck-by hazards associated with working in a trench without adequate access and egress.  The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017, employees were replacing a 15 inch clay pipe in an excavation measuring approximately 20.5 feet deep X 45 feet long X 8 feet wide without a ladder, ramp or other safe means of egress.

The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017.  Employees were exposed to struck-by hazards while working below excavated rock, dirt and soil piles located within 2 feet of the excavation edge.

The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017 where the employer was lifting and transporting employees in the bucket of a John Deere 350G LC excavator as a means of access and egress for a 20.5 foot deep excavation.

29 CFR 1926.652(a)(1):  Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  The employer is failing to protect employees from struck-by and engulfment hazards associated with trenching and excavations. The most recent example of this was on December 31, 2019 at or near 1505 Schoettler Road, Chesterfield, Missouri 63017.  Employees were performing work on a sanitary sewer within an trench measuring approximately 20.5 feet deep X 45 feet long X 8 feet wide.  The protective system used by the employer was not adequately installed and exceeded the manufacturer's requirements.   An employee was injured in this trench due to a trench collapse on December 31, 2019, and later that same day, the employer allowed another employee to enter the same trench without taking appropriate measures to ensure safety.
