29 CFR 1926.62(d)(1)(iii): The employer did not collect personal samples representative of a full shift, including at least one sample for each job classification in each work area, either for each shift or for the shift with the highest exposure level: (a) On and before January 3, 2019, during the shutdown operations occurring at 900 E. Keefe Ave., Milwaukee, WI 53212, the employer did not collect personal samples representative of a full shift for employees performing disassembly and demolition tasks. This exposed employees to lead hazards while disturbing lead dust during disassembly of machinery utilizing processes including cutting with reciprocating saws and acetylene torches. Additionally, any engineering controls present in the work areas were not designed for the work locations or body positions that existed during the shutdown operations. The lack of representative exposure monitoring for any work performed during the shutdown operations exposed employees to lead hazards of unknown magnitude, and decisions regarding respiratory protection were made by the employer without assessing the true concentrations of airborne lead in the work area. (b) On and before January 3, 2019, during the shutdown operations occurring at 900 E. Keefe Ave., Milwaukee, WI 53212, the employer did not collect personal samples representative of a full shift for employees performing equipment transportation and washing tasks. This exposed employees to lead hazards while disturbing lead dust while transporting and power washing machinery. The lack of representative exposure monitoring for any work performed during the shutdown operations exposed employees to lead hazards of unknown magnitude, and decisions regarding respiratory protection were made by the employer without assessing the true concentrations of airborne lead in the work area. (c) On and before January 3, 2019, during the shutdown operations occurring at 900 E. Keefe Ave., Milwaukee, WI 53212, the employer did not collect personal samples representative of a full shift for employees performing equipment packaging tasks. This exposed employees to lead hazards during packing tasks. The lack of representative exposure monitoring for any work performed during the shutdown operations exposed employees to lead hazards of unknown magnitude, and decisions regarding respiratory protection were made by the employer without assessing the true concentrations of airborne lead in the work area.

29 CFR 1926.62(d)(7): Additional exposure monitoring was not conducted when there had been a change of equipment, process, control, personnel, or a new task initiated that may have resulted in employees already exposed at or above the action level being exposed above the permissible exposure limit: (a) On and before January 3, 2020, at the worksite at 900 E. Keefe Ave., Milwaukee, WI 53212, the employer did not perform additional exposure monitoring when there had been a change of equipment, process, controls, personnel levels, a new task initiated, or when demolition work progressed through various areas of the plant with higher or lower lead amounts. This exposed employees to unknown lead levels while disturbing lead dust. The lack of exposure monitoring for any work performed during the shutdown operations exposed employees to lead hazards of unknown magnitude, and decisions regarding respiratory protection were made by the employer without assessing the true concentrations of airborne lead in the work area.
