OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Yard Area: On or before October 10, 2019, and at times prior, the employer exposed employees to fall hazards in that employees were allowed to climb on top of a semi-truck trailer, approximately 12.5 feet from the ground, to adjust overhanging trash prior to rolling the tarp back over the payload of trash.

29 CFR 1910.333(c)(3)(i)(A)(1): When an unqualified person was working in an elevated position near overhead lines with voltages to ground rated at 50 kV or below, the location was not such that the person and the longest conductive object he or she could contact was more than 10 feet: a) Semi-trailer Tractor Staging Area Near Scale House: On or before September 18, 2019, and at times prior, employees were exposed to an electrocution hazard in that the employer did not ensure that Riverline Transfer Inc. employees did not come within 10 feet of the sagging power line by telling MAD Industries Inc. truck drivers not to park under the 14.4 kV sagging power line.
