29 CFR 1910.132(d)(1):  The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE).   (a)  On or about January 6, 2020, the employer had not completed an adequate workplace hazard assessment, in that the affected employees were not required to use personal protective equipment, such as but not limited to safety glasses with side shields, safety shoes, and gloves, to protect them from the hazards, such as but not limited to eye and face hazards, hand hazards, foot hazards, and possible respiratory hazards, that were identified in the hazard assessment.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.133(a)(3): The employer shall ensure that each affected employee who wears prescription lenses while engaged in operations that involve eye hazards wears eye protection that incorporates the prescription in its design, or wears eye protection that can be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses.  (a)  On or about January 6, 2020, employees working as inspectors were not required to wear safety glasses with side shields when inspecting machined parts that were oily and using Dykem Remover (eye and skin irritant) to clean the parts while inspecting.  These employees wore prescription glasses that were not safety glasses with side shields.  (b)  On or about January 14, 2020 a CNC operator was wearing regular prescription glasses without side shields, and was not wearing safety glasses with side shields when working on CNC machines using Blue Cool E2350 which contained ethanolamine, a known irritant.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures. 29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  (a)  On January 6, 2020, the employer had not provided information and training for employees on hazardous chemicals used in the workplace, such as but not limited to Dykem Remover (skin and eye irritant) and Gentech degreasing solvent (irritant, possible carcinogen).   (b)  On or about January 6, 2020, the employer did not provide employees with training when new chemicals were used in the workplace, such as Blue Cool E2350 which had recently been used as coolant in the CNC machines and contained ethanolamine, an irritant and sensitizer.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
