29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system: (a) On or about December 2, 2019, as the controlling employer, did not ensure employees of RMS Cranes, LLC and its employee were protected from falls hazards, while working on top of shipping containers, in excess of four feet above the lower working surface, without the benefit of fall protection systems being in place.
