29 CFR 1926.20(b)(1): It was the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with Part 1926. (a) At the demolition site, on or about January 6, 2020 and at times prior to, employees were exposed to crushed-by hazards when the employer did not initiate and maintain an accident prevention program and/or safety and health program to comply with the regulations of this part which included, but were not limited to, employee protection when exposed to hazards associated with free falling equipment, as well as bracing and/or supporting mechanical equipment, during demolition activities.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) At the demolition, on or about January 6, 2020, and at times prior to, employees were exposed to crushed-by hazards when the employer did not provide employees with training that included procedures for the safe dismantling and demolition of an industrial complex including equipment such as, but not limited to, large filter presses.
